1. Agreement

These Terms of Use (“Terms”) govern your use of ride.yd.com (the “Site”), the Micromobility Safety Revolution Academy (the “Academy”), our digital content, and the Ride Rules application (together, the “Services”), operated by Young Drivers of Canada and YD Labs and Research Inc. (together, “we,” “us”). By using the Services, creating an account, or making a purchase, you agree to these Terms and to our Privacy Policy and Return & Refund Policy, which are incorporated by reference. If you do not agree, do not use the Services.

2. Eligibility and accounts

You must be at least 16 years old to create an account; if you are under the age of majority in your province or territory, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf. You agree to provide accurate registration information, keep your credentials confidential, and notify us of any unauthorized use of your account. You are responsible for activity under your account. Accounts are personal and may not be shared, sold, or transferred.

3. Purchases

Prices are stated in Canadian dollars unless otherwise indicated and may change without notice (changes do not affect completed purchases). Applicable taxes are added at checkout. Payment is processed by third-party payment processors; we do not store full payment card details. By purchasing, you confirm you are authorized to use the payment method provided. Purchases made through third-party platforms (including Amazon) are governed by that platform’s terms and policies, not these Terms. Refunds are governed by our Refund & Return Policy.

4. License to courses and digital content

When you purchase or enrol in a course or download digital content (including e-books, sample chapters, and course materials), we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use that content for your own personal, non-commercial learning. You may not: share your course access or account; copy, record, download (except where a download function is provided), redistribute, publish, or publicly display course content; use the content to create competing courses or derivative training materials; remove copyright or trademark notices; or use automated tools to scrape or extract content. Course access is provided for a period of 12 months from enrolment. Organizational, cohort, and multi-seat use requires a separate written license.

5. Intellectual property

The Services and all content – including course materials, videos, text, graphics, the Micromobility Safety Revolution book series content, the Micromobility Safety Pyramid and MADAS frameworks, and associated designs – are owned by or licensed to Young Drivers of Canada and/or YD Labs and Research Inc. and are protected by copyright, trademark, and other laws. Young Drivers®, Collisionfree!®, and Micromobility Safety Revolution™ are trademarks used under authorization. No rights are granted except as expressly stated in these Terms.

6. Certificates

Certificates issued on completion of Academy courses are certificates of completion only. They confirm that the named learner completed the course and any associated assessments. They are not a government-issued license, permit, insurance qualification, or professional certification, and do not confer any legal riding privilege or exemption. Certificates may be revoked where completion was obtained through account sharing, cheating, or other violation of these Terms.

7. Acceptable use

You agree not to: violate any law; interfere with or disrupt the Services; attempt to gain unauthorized access to any system, account, or data; upload malicious code; misrepresent your identity or completion of coursework; or use the Services to harass others. We may suspend or terminate accounts that violate these Terms, with refunds handled per the Refund & Return Policy where required by law.

8. Safety education disclaimer — IMPORTANT

Our books, courses, applications, and content provide educational information about riding safety. They are not a substitute for lawful, attentive, and responsible riding, for compliance with the laws of your jurisdiction, or for your own judgment in real conditions. Traffic environments are inherently variable and hazardous, and no education, training, technology, or content can eliminate the risk of injury or guarantee any safety outcome. You are solely responsible for your riding decisions, for verifying and obeying the laws that apply where you ride, for the condition of your vehicle and equipment, and for assessing your own abilities and limits. Information about laws and regulations (including in the Ride Rules application) is provided for general guidance, may contain errors or become outdated, and is not legal advice – always confirm current local requirements with official sources.

9. Disclaimer of warranties

The Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, and we do not warrant that the Services will be uninterrupted, error-free, or secure. Some jurisdictions do not allow certain warranty exclusions; where consumer protection law grants you non-waivable rights, those rights are not affected by these Terms.

10. Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from or related to the Services, and our total aggregate liability for any claim will not exceed the greater of (a) the amount you paid us for the Service giving rise to the claim in the 12 months before the claim arose, and (b) CAD $100. Nothing in these Terms limits liability that cannot be limited by law, including under applicable consumer protection legislation.

11. Indemnity

You agree to indemnify us against claims, damages, and expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Services, except to the extent caused by our own negligence or wilful misconduct.

12. Third-party services and links

The Services may link to or interoperate with third-party sites and services (including Amazon, payment processors, and social platforms). We are not responsible for third-party content, terms, or privacy practices.

13. Changes to the Services and these Terms

We may modify, suspend, or discontinue any part of the Services, and may update these Terms from time to time. Material changes will be posted with a new effective date and, for account holders, notified by email or in-Service notice. Continued use after changes take effect constitutes acceptance. If you do not accept updated Terms, stop using the Services; refund rights, if any, are addressed in the Refund & Return Policy.

14. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Subject to any non-waivable consumer rights to bring proceedings in your home jurisdiction, the courts of Ontario will have jurisdiction over disputes arising from these Terms.

15. General

If any provision of these Terms is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the policies incorporated by reference, are the entire agreement between you and us regarding the Services. You may not assign these Terms; we may assign them in connection with a corporate transaction.
